The primary function of the Consumer Post Closing Department is to safeguard against risk that Associated Bank may otherwise be exposed to through deficiencies in loan documentation or lack of adherence to government regulations or internal compliance requirements. This is accomplished through review and analysis of closing documents on all loan files. Under direct/moderate supervision, verify that closing documents are complete and correct and that all elements of the file are in keeping with the regulations that apply to that particular loan type. Ensure that our lien can be perfected and the Note and Mortgage are defendable in case of a legal action. Deliver legal documents to the title company for recording. Work with borrowers, lenders, title companies, government agencies, processors and underwriters as needed.

This person will also:

  • Audit consumer loan files to validate they were closed in accordance with the underwriter approval terms in the Loan Origination System.

  • Review collateral documents and compare to other data in the file as well as data from title companies and government agencies as needed, to ensure the correct collateral has been noted on the forms and that our lien will be perfected timely.

  • Submit mortgages and other legal documents for recording and adherence to internal compliance requirements and all regulatory guidelines. This includes careful review of mortgage and title documentation for a clear, enforceable lien.

  • Revisions are made to closing documents when inaccuracies or deficiencies are found and corrected documents making sure corrected documents are returned and our servicing system reflects the precise terms of the loan.

  • Log and document all errors and omissions for reporting to upper management, following the Colleague Accountability Program.

  • Track trailing loan documents including, among other things, recorded mortgages and other lien perfection documents, final title policies and proof of lien position, proof of insurance and Loan Contracts. Using exception reports follow up to obtain outstanding documents. This will require working with borrowers, lenders, title companies and government agencies to research and analyze strategies for clearing the outstanding items. Once received, documents are to be reviewed for completeness and added to the Nautilus loan file.

  • Review all consumer loan files intended for pledge to the Federal Home Loan Bank, (FHLB) to ensure the files meet the documentation requirements and other specified characteristics of pledgeable loans as defined by the FHLB using the FHLB checklist. Log ineligible loans to be coded for No Pledge in the Servicing System.

  • Review KYA/KYC forms and Lender's Affidavit of Closing for each file to verify the forms have been completed with the information required by the Customer Information Program, (CIP), and Know Your Customer, (KYC), policies found in the Standard Operating Procedures manual, (SOP). Work with Lenders as needed to obtain missing or incomplete information. Once the forms are completed, enter the data provided into the Customer Information Tracking System.
