The salary range for this role, based in New York is $152,880.00 to $191,100.00. The range will vary if outside of this location. Base salaries are determined during our interview process, by assessing a candidate'sexperience, skills against internal peers and against the scope and responsibilities of the position.

Position Summary

  • Serve as lead counsel on data privacy and protection legal requirements and standards for U.S
  • Manage and negotiate all marketing technology, ecommerce, SaaS, digital and IT related agreements, including coordinating with Global Privacy Team on as needed basis
  • Provide business-minded and enterprise-wide legal support to technology, IT, marketing, and related teams

Major Responsibilities / Accountabilities

  • Draft, review, and negotiate contracts, with a particular focus on software (SaaS), technology, data licensing and e-commerce agreements
  • Develop and refine agreement templates and playbooks to drive for cross-functional efficiencies and close deals with third party partners and customers quickly
  • Partner closely with the transformation, data analytics and management, digital, marketing technology and IT business teams to understand the digital strategy and apply a legal and commercial lens, enabling business objectives and resolution of any legal concerns
  • Advise on initiatives and governance issues related to marketing and emerging technology, including but not limited to generative AI and NFTs
  • Develop and implement privacy, data security, and breach preparedness related policies, processes, and controls within the organization to maintain compliance with data privacy laws
  • Draft terms of use required for brand digital platforms and initiatives. Oversee ongoing enterprise-wide data-mapping effort
  • Support Global Privacy Team on implementation of privacy framework, including but not limited to performing Privacy by Design review and Privacy Impact Assessments where applicable
  • Liaise with global counterparts and stakeholders as needed
  • Engage in special projects and other duties, as assigned

Nature and Scope

  • This employee will be handling sensitive information regarding our IT systems and platforms and marketing programs, both internally and externally
  • This person must be able to conduct efficient legal review and decision making and manage risk issues, as appropriate
  • They will monitor developments in the data protection legal landscape and serve as in-house privacy, digital and technical expert
  • The person must also be able to manage outside counsel fees efficiently
  • This person should also demonstrate the capability to implement solutions on an enterprise level beyond the IT and Marketing teams, and exhibit curiosity about learning the business from all fronts

Requirements

- Education:

  • JD with license in NY (or reciprocity) required
  • Experience with alcohol beverage and/or other consumer or ad technology products law is preferred
  • Strong candidates with previous in-house or top law firm experience are encouraged to apply

- Experience / Background:

  • 4+ years relevant attorney-level experience in law firm/in-house legal department
  • CIPP/US Certification preferred
  • Strong working knowledge of intellectual property laws and concepts, data privacy and security laws (including state laws, CCPA and TCPA) and best practices, and drafting and negotiating complex software technology (Saas) agreements, direct sourcing agreements, and professional services agreements specifically related to technology-related businesses; experience in ecommerce and marketing technology (martech) agreements
  • Admitted to the bar in NY and in good standing or otherwise authorized to practice law in NY (e.g., have registered in-house status)
  • Ability to work with and manage outside counsel effectively and efficiently
  • Ability to work autonomously

  • Navigate risk by creating effective and commercially viable legal solutions to complex business matters
  • Manifest strong working relationships cross-functionally on legal and business matters
  • Exercise independent, informed, and considered judgment with minimal supervision
  • Maintain composure and high-performance standards in a challenging environment and push back when necessary
  • Communicate complex issues/conclusions succinctly and in a "big picture" way
  • Consider the bigger picture (including business needs and opportunities) when assessing specifics of an issue

  • Work is performed in a typical office environment

  • Normal visual, hearing and language acuity required for correspondence and computer usage
  • Occasional Travel (Est. 5% of the time)
