SUMMARY OF DUTIES:
The Director, Commercial Strategy & Development supports contract and bid document development, incentive/disincentive strategy, market research, market outreach, and 3rd party stakeholder agreements for Capital Delivery (CAPD) in the Program Development and Project Services (PDPS) department. Incumbent will support industry-focused analysis of alternative delivery methods for capitally-funded projects. Incumbent ensures that policies, procedures and standards comply with various legal and FRA agency requirements. Incumbent will support our Project Teams on commercial matters in the planning, procurement, and execution phases of construction projects.
ESSENTIAL FUNCTIONS:
* Supports the Sr. Director, Delivery Strategy & Commercial Strategy in the analysis of alternate delivery methods for use in capitally-funded projects. Reviews and proposes latest industry best practices for alternative delivery methods that follow latest regulatory regulations/requirements.
* Provides consulting services to support contract development, contract negotiations (as needed) and synthesizes recommendations to company leadership for decision making purposes.
* Supports the development of contract language for alternative delivery procurements. Supports selection plan development with Procurement and Project Delivery teams.
* Collaborates closely with General Counsel and Procurement teams to advance commercial terms and finalize agreements with contractors, consultants, suppliers and vendors ensuring that commercial terms and contract agreements are aligned and approved.
* Develop solutions for alternative delivery agreements that meet the needs of both internal and external stakeholders and Amtrak, and ensures that commercial language and incentive structures are structured to align with budget requirements.
* Ensures that standard offering documents are updated and contain all business requirements that are aligned with Amtrak needs and all stakeholders are aligned on contract requirements and scope of work deliverables.
* Works with Engineering Services, Program Development and Project Services, Project Delivery, Procurement, and Law departments to ensure compliance with procurement policies while developing commercial language for procurement of contractor and engineering services necessary to deliver capitally-funded projects.
* Supports solicitation development activities to ensure the appropriate contract vehicle is established to meet the execution requirement of the CAPD office in charge.
* Ensures procurement documents are developed to align with Business Case, Project Charter, and Project Management Plan recommendations.
* Supports pre-award activities to ensure source selection plan, evaluation criteria, solicitation amendments, pre-proposal conferences, and question clarification responses are appropriate, timely, and provide value to Amtrak.
* Collaborates with Procurement and Supply Chain team to ensure evaluation criteria is developed according to industry best practice and Amtrak procurement requirements.
* Maximizes contractor and designer procurement participation by supporting market analysis/outreach as well as ensuring that all bid questions are responded to appropriately and completely.
* Engages with Project Delivery teams and reports on contract status, contractor performance and cost effectiveness of contract to Sr. Director, Delivery Strategy. Monitors and supports the resolution, as needed, of contract performance issues.
* Supports Project Teams on commercial issues that arise during project execution, including claims and change order evaluations/analysis and support.
* Provides monthly performance and compliance reporting to senior leadership as needed.
* Supports contract compliance and reviews what commercial terms are meeting/exceeding contract effectiveness expectations, as well as, taking lessons learned from active contracts and incorporating them in future commercial term development.
* Monitors status of alternative delivery procurement initiations and follows up with Procurement team and related departments to establish timely contract agreements.
* Supports development of all alternative delivery procurement documents and meets procurement milestones as defined by Project Charters and Amtrak's Integrated Master Schedule.
* Performs a wide range of project, program, and policy development functions including conducting research, data analysis and framing recommendations for future contractual actions.
* Develops project and program plans in collaboration with Delivery Strategy team to streamline contracting processes and improve quality of statements of work and contract terms; leads project and program implementation tracking and assess impacts and results.
* Maximizes value by developing incentive structures and alternative delivery methods.
* Collaborates and builds relationships with internal Amtrak stakeholder offices to efficiently manage all acquisition planning and contract compliance activities and ensure all stakeholder groups are engaged to maximize value in our commercial terms, thereby, mitigating commercial challenges downstream.
* Develops and executes research projects to address CAPD planning, procurement, and delivery needs.
* Responsible for market analysis and the execution, analysis, and report out on research findings for market trends, contractors, consultants, suppliers, and vendors to help maximize competition.
* Conducts market outreach and develops strong working relationships and engagement with contractors, consultants, suppliers, and vendors to increase competition.
* Develops, programs, and launches in-house customer surveys; analyzes survey data; crafts discussion guides for qualitative studies, and manages ongoing internal surveys.
* Creates and maintains a repository of internal feedback to better support our internal stakeholders and maximize opportunities for improvement based on survey results.
* Monitors developments and trends in the transportation industry to increase competition and reduce commercial risk.
MINIMUM QUALIFICATIONS:
* Bachelor's Degree in Law, Engineering, Construction, Contract Management, Business, or equivalent combination of training, education and relevant experience may be considered in lieu of a degree.
* Demonstrated experience and ability to produce results within a team environment, to develop productive working relationships with external and internal stakeholders and to appropriately challenge or influence decisions.
* Demonstrated contracts experience in government and private construction environments.
* Demonstrated experience with contract and commercial language development.
* Mastery of critical thinking/problem solving, written and verbal communication, business acumen, and decision making abilities.
PREFERRED QUALIFICATIONS:
- Juris Doctor
- 11-14 years of experience preferred
- Demonstrated experience with alternative delivery construction contracts (e.g., Design-Build, Construction Manager at Risk, Progressive Design-Build, Public Private Partnership, Alliance)
- Demonstrated experience working collaboratively in a fast-paced team environment as well as taking timely responsibility for assigned tasks
- Demonstrated experience supporting project teams on commercial matters in the execution phase including change order and claims evaluation, analysis, and support
- Demonstrated experience with business development and/or market research/analysis
WORK ENVIRONMENT:
* Position requires 4 to 5 days in the office.
* Position will require work outside of normal business hours as necessary.

Must have excellent oral and written communication skills.
The salary/hourly range is $163,000-$211,140, Pay is based on several factors including but not limited to education, work experience, certifications, internal equity, etc. Depending on an employee's assigned worksite or location, Amtrak may consider a geo-pay differential to be applied to the employee's base salary. Amtrak may offer additional incentive and pay programs to recognize and reward our employees, including a short-term incentive bonus based upon factors such as individual and company performance that is commensurate with the level of the position and/or long-term incentive plan compensation.
