Title: Assistant General Counsel Labor and Employment

Location: Primarily remote; candidate must be local and have the ability to travel onsite to our various locations (Burlington Headquarters, Tufts Medical Center in Boston, Lowell General Hospital, MelroseWakefield Hospital).

Job Profile Summary

This role focuses on ensuring the organization's business activities are conducted ethically and in compliance with relevant regulations, laws, and standards. In addition, this role focuses on performing the following Legal Counsel duties: Provides legal advice/counsel in business-related areas, researches, analyzes, and interprets proposed and existing laws, statutes, and regulations, identifies, monitors and addresses issues of legal risk, structures, drafts, negotiates and/or approves legal contracts, letters of agreement, policies and other documents, represents/advocates for an organization in litigation, arbitration, mediation or other disputes with courts, government agencies, or other legal authorities. A professional individual contributor role that may direct the work of other lower level professionals or manage processes and programs. The majority of time is spent overseeing the design, implementation or delivery of processes, programs and policies using specialized knowledge and skills typically acquired through advanced education. An experienced level role that applies practical knowledge of job area typically obtained through advanced education and work experience. Works independently with general supervision, problems faced are difficult but typically not complex, and may influence others within the job area through explanation of facts, policies and practices.

Job Overview

The position is responsible for providing strategic legal advice for the Health System on labor and employment matters, including its hospitals, agencies and physician organizations. Provides high-quality, practical advice and support for Human Resources (HR) and management on a wide range of day-to-day issues including performance and conduct management, discipline and terminations, leave of absence, disability, wage and hour, benefits and other matters in a fast-paced environment. Represents the Health System with respect to agency and administrative charges and pre-litigation disputes. Responsible for investigation and evaluation of claims before administrative agencies and state and federal courts. Counsels and creates workplace policies and procedures that follow federal, state, and local employment laws and help minimize conflict and lawsuits.

Job Description

Minimum Qualifications:

1. Juris Doctorate Degree.

2. Licensed to practice law in the Commonwealth of Massachusetts.

3. Three (3) years of experience in labor and employment law, either in a law firm setting, in-house setting, or combination of both.

Preferred Qualifications:

1. Five (5) years of experience in labor and employment law.

Duties and Responsibilities: The duties and responsibilities listed below are intended to describe the general nature of work and are not intended to be an all-inclusive list. Other duties and responsibilities may be assigned.

1. Provide legal advice and counsel to members of the medical, professional and administrative staff on matters affecting the operation of the Health System.

2. Represent the Health System and its affiliates on various legal matters in court and at hearings before administrative review boards and federal, state, and municipal governmental regulatory bodies.

3. Assist in the development of Health System policies, procedures, and forms pertaining to patient care, labor and employment, and administrative matters by reviewing and recommending revisions to new or existing policies, procedures, and forms to conform with legal standards and requirements.

4. Review, draft, and negotiate leases and contracts involving the Health System and its affiliates.

5. Participate in the development and maintenance of systems to ensure data storage, processing, and retrieval related to incident and event reporting and credentialing information.

6. Present educational material and disseminate information relating to relevant legal issues to Health System medical, professional, technical, and administrative staff and serves as faculty for continuing education programs.

7. Maintain collaborative, team relationships with peers and colleagues to effectively contribute to the working group's achievement of goals, and to help foster a positive work environment.

8. Represent Health System Boards and Committees and advise on nonprofit corporate governance matters

9. Collaborate and provide guidance to certain members of the legal staff, including paralegals and support staff.

Physical Requirements:

1. Normal office work environment, in a fast-paced department. May be required to lift 10-20 pounds occasionally.

2. Occasional travel to other Tufts Medicine system sites for interviews/meetings.

Pay Range:

$111,175.79 - $141,756.53
