Job Summary

Responsible for handling a variety of routine legal matters generated by the activities of the University, including drafting and reviewing contracts on behalf of the FIU Academic Health Center (AHC) and FIU Health Care Network Faculty Practice Plan (FIU-HCN), regarding agreements related to the operation of the AHC and the FIU-HCN. The AHC includes the College of Medicine, the College of Nursing, the College of Public Health and Social Work, and other units such as the FIU Center for Children and Families. Provides legal advice, counseling, education, and training on basic legal issues to promote compliance with legal regulations and to reduce exposure to legal risks. Works under the supervision of the General Counsel or Deputy General Counsel for Health Affairs when working on significant contracts or transactions, as needed. Oversees or handles representation of the University in minor litigation or administrative proceedings, as needed.

  • Oversees the drafting and review of contracts on behalf of the AHC and the FIU-HCN, including managed care agreements, software and hardware agreements, health care equipment agreements, affiliation agreements, leases and other agreements related to the operation of the AHC and the FIU-HCN.
  • Assist with State health care regulatory matters including licensure and mandatory reporting.
  • Perform legal research, analyze issues, draft memoranda, and provide guidance to regarding for health care matters to the AHC and the FIU-HCN.
  • Research legal issues in connection with FIU-HCN policy development.
  • Ability to synthesize legal issues and provide practical advice to clients. Provide legal guidance arising out of day-to-day operational issues for the AHC and the FIU-HCN.
  • Exercise good judgment in matters needing notice to higher level managers within the FIU-HCN and the AHC.
  • Stay apprised of the latest developments in health care laws applicable to the AHC and the FIU-HCN.
  • Provide legal advice to Information Technology leadership regarding the purchase, licensing and implementation of HIPAA compliant health information security systems.
  • Must have excellent communication, written and verbal skills and must be a client centered problem solver. In addition, the applicant must have a history of progressively responsible legal experience and must be able to provide a record of accomplishment.
  • Assist with such additional matters as may be assigned by the Office of the General Counsel's Deputy General Counsel for Health Affairs or the General Counsel.
Minimum Qualifications

  • Law degree (L.L.B. or J.D.) and licensed to practice law with two (2) years of experience as an attorney.
  • Must be a member of the Florida Bar or become a member within twelve months of employment.
Desired Qualifications

  • Should have two (2) years handling health law or health-related matters preferably at or for a university, with an emphasis in health care operations and/or transactional matters. Areas of pertinent health law experience may include, but is not limited to, tax exempt organizations, Medicare and Medicaid reimbursement matters for both professional and facility entities, managed care contracting, fraud and abuse, state and federal laws governing privacy and security matters regarding patient health information, referral relationships, and compliance programs.
  • Experience as in-house counsel in an academic medical center or experience providing legal services to hospitals, hospital systems or medical providers within a law firm environment preferred.
  • Ability to handle the management of health care and/or university-related health transactions or review regulations related to health care or health-centric university transactions.
