Job Summary: The Associate General Counsel II is responsible for assisting the SVP, General Counsel, Deputy General Counsel and/or Senior Counsel in privacy and litigation matters. Further, the Associate General Counsel II will support a specified market, department, legal function, and/or CareSource affiliate/subsidiary. Essential Functions:
- Provide advice and guidance on state and federal privacy and data security laws and regulations, including HIPAA, CCPA, SAMHSA, TCPA, and other consumer protection laws.
- Serve as the subject matter expert for federal and state privacy laws, working with various areas of the company to provide guidance for implementation and compliance.
- Assist with the management of regulatory inquiries, investigations, and administrative actions related to privacy and data security.
- Assist in managing CareSource's litigation related activities including, active litigations, State Fair Hearings, subpoena responses, attorney demands, and provider complaints.
- Proactive support of the legal team to ensure up-to-date knowledge and influence of privacy laws and litigation trends.
- Interact with management team as well as with external representatives of the legal system, regulatory agencies, governmental entities and others.
- May supervise non-attorney staff or Staff Attorney I and IIs.
- Perform any other job-related instructions as requested.
Education and Experience:
- Juris Doctor degree from an accredited college/university is required.
- Five (5) years of privacy or privacy related experience is required, seven (7) years of experience is preferred. Litigation experience is required.
- Law firm or in-house experience is preferred.
- Deep knowledge of federal and state privacy and data security laws, regulations, and standards, including HIPAA, CCPA, and consumer protection, with an emphasis on healthcare related privacy regulations is required.
- Knowledge of federal and state healthcare laws and regulations is preferred.
- Experience managing outside counsel is preferred.
